CHRR In High Court Against Malawi For The Safe Abortion For A Sexually-Abused Minor

On September 28, 2023, a 14-year-old minor named AC, represented by the Center for Human Rights and Rehabilitation (CHRR) filed a case in the High Court of Malawi against the Blantyre District Council, the Attorney General, and the Human Rights Commission. The case argues that Malawi’s failure to provide sexual and reproductive health rights (SRHR), including access to safe abortion, for minors who are victims of sexual violence violates their rights under the African Charter on Human and Peoples’ Rights. The lawsuit alleges that the state’s actions have deprived the victim of her fundamental rights and access to healthcare. The legal team has submitted evidence showing how the state’s failure to protect the best interests of the child has led to stigma and further harm. This high-profile case aims to highlight the need for Malawi to guarantee SRHR access for minors who are victims of sexual violence.
